Terms and Conditions

Introduction

Welcome to Cine Estate! We provide professional videography and photography services for real estate properties. By booking our services, you agree to the following terms and conditions. Please read them carefully.

1. Definitions

Client: The individual or entity booking and paying for Cine Estate's services.
Company: Cine Estate, the provider of videography and photography services.
Services: Videography and photography services provided by Cine Estate.
Deliverables: The final edited videos and photographs produced by Cine Estate.

2. Booking and Payment

Booking Confirmation: A booking is confirmed only after receipt of a signed contract and payment of a non-refundable deposit of 50% of the total service fee.
Payment Terms: The remaining balance is due upon delivery of the final deliverables. Payments can be made via credit card, bank transfer, or other approved methods.
Cancellation Policy: Cancellations must be made in writing at least 7 days prior to the scheduled shoot. Cancellations made within 7 days of the shoot will incur a cancellation fee of 50% of the total service fee.

3. Services

Scope of Work: The services provided will be detailed in the contract signed by the client. Any additional services or changes to the scope of work must be agreed upon in writing and may incur additional fees.
Shooting Schedule: The client agrees to provide Cine Estate with access to the property and sufficient time to complete the shoot as per the agreed schedule.
Weather Conditions: If weather conditions are unsuitable for shooting, Cine Estate reserves the right to reschedule the shoot. The client will be informed in advance of any such rescheduling.

4. Deliverables

Delivery Time: Cine Estate will deliver the final edited videos and photographs within 10 business days of the shoot, unless otherwise agreed upon.
Format: Deliverables will be provided in digital format, typically via a secure online download link. Alternative delivery methods can be arranged upon request.
Revisions: The client is entitled to one round of revisions. Additional revisions will incur extra charges.

5. Intellectual Property

Ownership: Cine Estate retains all intellectual property rights to the deliverables until full payment is received. Upon full payment, the client is granted a non-exclusive, royalty-free license to use the deliverables for marketing and promotional purposes.
Usage Rights: Cine Estate reserves the right to use the deliverables for its own marketing and promotional purposes, including but not limited to portfolio displays and social media.

6. Client Responsibilities

Property Access: The client must ensure Cine Estate has access to the property at the scheduled times and that the property is in a shoot-ready condition.
Permissions: The client is responsible for obtaining any necessary permissions or permits for the shoot.
Accuracy of Information: The client must provide accurate information about the property and any specific requirements or preferences.

7. Liability

Limitation of Liability: Cine Estate’s liability for any claim arising out of this agreement is limited to the total amount paid by the client for the services. Cine Estate is not liable for any indirect, incidental, or consequential damages.
Indemnification: The client agrees to indemnify and hold Cine Estate harmless from any claims, damages, or expenses arising out of the client’s breach of these terms and conditions or any actions related to the shoot.

8. Miscellaneous

Governing Law: These terms and conditions are governed by and construed in accordance with the laws of the jurisdiction in which Cine Estate operates.
Severability: If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Amendments: Cine Estate reserves the right to amend these terms and conditions at any time. Clients will be notified of any significant changes.

Return and Refund Policy

1. General Conditions

Eligibility: To be eligible for a return or refund, the client must provide a valid reason related to the quality of the services or deliverables.
Time Frame: Requests for returns or refunds must be made within 14 days of receiving the final deliverables.

2. Return Conditions

Service Issues: If the client is not satisfied with the quality of the services or deliverables due to errors or omissions on the part of Cine Estate, the client must notify Cine Estate within 14 days of delivery, detailing the specific issues.
Revisions: Cine Estate will first offer to make reasonable revisions to address the issues. If the client is still not satisfied after the revisions, a refund may be considered.

3. Refund Conditions

Refund Requests: All refund requests must be made in writing and sent to info@cineestate.com. The request must include the client's name, contact information, service details, and a detailed explanation of the reason for the refund request.
Refund Evaluation: Cine Estate will review the refund request and may request additional information or clarification. Refunds are not guaranteed and will be issued at the discretion of Cine Estate based on the merit of the request.
Partial Refunds: In cases where some but not all of the services or deliverables are deemed unsatisfactory, Cine Estate may offer a partial refund corresponding to the unsatisfactory portion of the services.
Non-Refundable Fees: Certain fees, such as the initial booking deposit, are non-refundable except in cases where Cine Estate fails to provide the agreed-upon services.

4. Exclusions

Client-Requested Changes: Refunds will not be granted for issues arising from client-requested changes or modifications made after the initial agreement and confirmation of the scope of work.
External Factors: Cine Estate is not responsible for and will not issue refunds for issues caused by external factors beyond its control, such as weather conditions, property access issues, or other unforeseen events.

5. Processing Refunds

Approval: Once a refund request is approved, Cine Estate will process the refund within 14 business days.
Method: Refunds will be issued using the original method of payment unless otherwise agreed upon.
Notification: The client will be notified via email once the refund has been processed.
